Welcome to Fit Launch Studio. These Terms and Conditions ("Terms") govern your use of all mobile applications published by Fit Launch Studio and the website fitlaunchstudio.com (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
By downloading, installing, or using any Fit Launch Studio application, or by visiting our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may update these Terms from time to time, and continued use constitutes acceptance of any changes.
You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Services. Certain features of our apps may be available through paid subscriptions or one-time purchases. All payments are processed through Apple's App Store and are subject to Apple's terms and conditions. Subscription terms, pricing, and renewal information are displayed within each app prior to purchase. You may manage or cancel subscriptions through your Apple ID settings. Refund requests should be directed to Apple in accordance with their refund policies.
You agree not to use the Services for any unlawful purpose or in any way that could damage, disable, or impair the Services; attempt to gain unauthorized access to any part of the Services or any systems or networks connected to the Services; reverse engineer, decompile, or disassemble any part of the Services; use the Services to transmit any malicious code, spam, or harmful content; or impersonate any person or entity or misrepresent your affiliation with any person or entity.
All content, features, functionality, design, graphics, trademarks, and other intellectual property in the Services are owned by Fit Launch Studio or its licensors and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content in the Services without our express written permission.
The Services are designed for general fitness and wellness purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before beginning any exercise program or making changes to your diet or lifestyle. You use the fitness features of our apps at your own risk. Fit Launch Studio is not liable for any injury, health issue, or damage resulting from your use of the Services.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by applicable law, Fit Launch Studio and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use or inability to use the Services; any unauthorized access to or alteration of your data; or any other matter relating to the Services.
You agree to indemnify, defend, and hold harmless Fit Launch Studio and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
Our apps may contain links to or integrations with third-party services. We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those services.
We reserve the right to suspend or terminate your access to the Services at any time, with or without cause and with or without notice. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved in the competent courts of the Netherlands.
